Here’s an email I got from Max Grossman this afternoon.
Dear Friends,
This is to inform you that the City of El Paso has filed a declaratory judgment action in Travis County in a bid to (1) validate the Quality of Life Bond and (2) confirm that the sports arena will be built downtown and that Union Plaza is an acceptable location. The City has hired a very expensive national firm, Norton Rose Fulbright, to lead the effort and is apparently ready to spend a huge amount of money to litigate, greatly increasing the cost of this project to the taxpayers.
Frank Ainsa, who is leading the legal team that intends to compel the City to select an alternate site for the sports arena, received a letter from the City yesterday morning with the declaratory judgment action attached. That letter is a public document and is currently available.
