On December 9, my legal team filed a brief in response to the El Paso Children’s Hospital (EPCH) motion to dismiss by asserting a governmental immunity claim. The actions by the El Paso Children’s Hospital should send a collective chill down the spines of every young family in El Paso with children.
How can a hospital, which invests so heavily in ad nauseum marketing efforts convincing us to trust them with our most precious loved ones, then turn around and refuse to take responsibility when things go wrong? It’s an outrageous betrayal of the trust we place in them. EPCH is prioritizing its own protection over the very people it claims to serve.

I posted this on Martin’s website, El Paso News. So few of our media outlets give this any coverage because they are up against the local establishment that foisted the EPCH scam on us.
“EPCH was a scam from the get go. Remember the impassioned pleas to us voters, ‘It’s for the children!’ Then the so-called business case that showed it was not going to be profitable, so hire another consultant to come up with a case that showed it would be. Our $120MM bond issue built a building that has EPCH on it but is not actually EPCH and is owned by UMC that charged the “virtual” EPCH rent and services, i.e., it could milk the childrens’ hospital for cash that wasn’t strictly auditable.
This scheme backfired on UMC when reimbursement schedules changed and the corporate entity that is EPCH found itself in trouble. I don’t known where this boondoggle stands today except that the politicians who pushed it take no accountability for the mess they designed.”
